Act on Award of Public Procurements

In the Collection of Laws the Act No. 134/2016 Coll., on Award of Public Procurements was published. We have already informed you about its proposal - see http://www.baroch-sobota.cz/en/new-act-on-public-procurement.

 Except the changes that were already mentioned in the above mentioned article, the contracting authority has newly the possibility to demand a proof of fulfilment of qualification requirements also on subcontractors that will take part in fulfilment of public procurement and he also has the possibility to pay the remuneration for the fulfilment of the public procurement directly to the subcontractor. The contracting authorities are also given more criteria for the evaluation of the quality of the offers so they will not be obliged to choose only according to the lowest price.

 The Act on Award of Public Procurements will come into force on October 1^st, 2016 and will replace the Act No. 137/2006 Coll., on Public Procurements.
