New Act on Public Procurement

A Government’s proposal of a new Act on Public Procurement was introduced to the Chamber of Deputies. This Act will replace the Act No. 137/2006 Coll., on Public Procurements.

 The proposal of the Government’s Act introduces many changes in comparison with the current legislation, for example:

-       the participant may be excluded from the procurement procedure if the participant has shown significant or persistent deficiencies in the performance of prior contractual relationship with the contracting authority of the contract or with other contracting authority in the past;

-       reintroduction of some qualification requirements, i.e. the contracting authority will be allowed to request that the participant has a certain minimum annual turnover;

-       introduction of the possibility to decrease the number of participants on procurement procedure;

-       the contracting authority will be allowed to choose the participant without evaluation if no other participant participated in the procurement procedure.

 The new Act on Public Procurement should come into force no later than 1st April 2016. We will inform you once the Act is adopted
