The period for filing protests against the bill payment order

The Constitutional Court of the Czech Republic decided with its finding from 16th of October 2012 (Pl. ÚS 16/12) about the unconstitutionality of the three-day period for filing protests against the bill payment order.

Such a short period leads to unbalance between the bill creditors and bill debtors when the bill debtors are exposed to an inadequate pressure which, in final consequence, does not follow the intended purpose –speed of bill payment order proceedings. The three-day period for filing protests in the relevant provision of the act (Section 175 Subsection 1 of the Code of Civil Procedure) shall be abrogated as of 30th of April 2013. By this date, an amendment to the Code of Civil Procedure (Act No. 404/2012 Coll.), which replaces the given period by a new eight-day period, comes into force.
