The Equality of Participants of Court Proceedings when Deciding about the Reimbursement of Court Proceedings

According to the Civil Procedure Code, the administrative costs of the proceedings (such as a postage) expended by the participant of the proceedings who is represented by an attorney shall be reimbursed in a flat rate of 300,- CZK as for one legal act. The participant who is not represented by the attorney must prove the exact amount of expended administrative costs.

The Constitutional Court of the Czech Republic decided in its decision as of 14^th October 2014, Reference Number Pl. ÚS 39/13, that such treatment of participants of court proceedings is unequal. Administrative costs which were expended by the participant who is not represented by the attorney should also be reimbursed in a flat rate.
