News on Energy Performance Certification

Since January 1st, 2016 the obligation of the owner of a building or a unit to obtain an energy performance certification of building will be extended.

The owner of a building or the association of unit owners are obliged to obtain an energy performance certification of building in case the building or its complex part are sold or the building as a whole is being leased and since January 1st, 2016 also in case the complex part of the building is being leased. The owner of a unit (of a flat as well as of a non-residential space) is obliged to obtain an energy performance certification of building in case of a sale of the unit and since January 1st, 2016 also in case of a lease of the unit.

In these cases the owner or the association of unit owners are obliged to present the energy performance certification of building or its certified copy to the potential buyer / lessee before the closing of the contract and at to hand it over to him/her latest by the signing of the contract.

New obligations are also set if the sale or the lease are advertised or arranged by a broker.

It is not necessary to obtain the energy performance certification of building for all kind of buildings as some exceptions were given, i.a. for industrial, manufacturing or agricultural buildings with consumption of the energy up to 700GJ or buildings for family recreation.

In case of breach of the above mentioned obligations a fine up to CZK 50.000 for natural person and up to CZK 200.000 for the legal person or the entrepreneurially active natural person can be inflicted.
