New Sanctions for Breaching Employers’s Duties

As of 1st January 2015 amendment of the Act No. 251/2005 Coll., on Labour Inspection, came into effect.

This amendment introduces among other things changes in the field of administrative offences.

The employer shall guarantee that the employee will not exceed the extent of work given by the Labour Code for the workers working on the grounds of the Agreement to Complete a Job and the Agreement to Perform Work. A breach of this obligation is an administrative offence and the employer could be sanctioned with a fine up to CZK 2,000,000.

The employer could also by sanctioned by a fine in the same amount in case he breaches the duties set for the commencement, changes or termination of the employment relationship, the Agreement to Complete a Job or the Agreement to Perform Work.

The amendment also changes the termination of the responsibility of the legal person for the administrative offence. The responsibility terminates if the administrative body did not start administrative offence proceedings within a year from the moment of the finding out about the administrative offence.
