New Legal Regulation of Administrative Offences

In the Collection of Laws two new acts regulating administrative offences were published, namely the Act No. 250/2016 Coll., on the Responsibility for the Administrative Offences and the Procedure on it and the Act No. 251/2016 Coll., on Some Administrative Offences. Both acts will come into force on July 1st, 2017 and they will replace the Act No. 200/1990 Coll., on Administrative Offences.

To the fundamental changes belongs the fact that the Acts will apply not only for the natural persons but also for the legal persons and natural persons carrying out business activities.

The new Act on the Responsibility for the Administrative Offences and the Procedure on it will be a general norm defining the administrative offences and the procedures on them. To the important changes belong for example the extension of the limitation period from 1 to 3 years in especially serious cases or the abolition of the ban on residence in municipality as a form of punishment for the administrative offence.

The second of the above mentioned Acts, the Act on Administrative Offences, regulates the individual administrative offences. The Act introduces some new administrative offences and also in a large number of cases increases the penalty.
