New conditions for purchases of properties in order to improve traffic infrastructure, becoming effective 1st March 2016

The amendment to Act No. 49/2016 Coll. changes from 1st March 2016 on the law No. 416/2009 Coll. concerning quicker organisation of traffic, water and electric infrastructure, as well as the expropriation law.

The new regulation changes the conventions of price determination during voluntary purchases of properties for building highways passing the country. Instead of the previous range in calculating prices, which was restricted by an upper limit, there will be one single permissible sum only now. Furthermore the law fixes a lower coefficient, which improves the prices for approval certificates of non-building plots.

It won’t be necessary to cancel the common ownership for expropriation of properties, which are owned by the state as a co-owner. Instead a direct expropriation of the other co-owners’ parts will be allowed.

In summary the purchase of in particular agricultural properties by the state for reasons of infrastructural improvement will take place at a lower price. Possible expropriation of properties co-owned by the state is going to proceed considerably faster.
