Impossibility of exclusion or shortening of 20day period within the duty of the cadastral office to inform the owner about the change of the legal circumstances connected with his/her property

The new duty of the cadastral office to inform the owner in the case, that his real estate is effected by the change of legal circumstances, which brought the act No. 256/2013 Col., about real estate cadastre (hereinafter “cadastral act”). This regulation should protect the property owner from fictive betrayal transactions in cadastre.

If all conditions for the allowance of the inscription are fulfilled, the cadastre office allows the inscription, but not before the 20days period since the sending of the information about the change of legal circumstances to the property owner. The regulation about the sending the information to the property owner and about the 20days period should protect the property owner. The property owner cannot wave in any way the protection, nor can he release the cadastre office from this obligation or to shorten this period for effecting the inscription, and nevertheless by one side declaration of the property owner towards cadastre office.
