Energy label - new obligation for real estate owners

On 01.01.2013 the amendment to the law Nr. 406/2000 Coll., about energy economy, which introduced an obligation for owners of some real estate to arrange the certificate of energy demand of the real estate, so called “energy label”, came into force.

The certificate should be drawn up by the construction of new building or by bigger rebuilding of finished building and annexed to the application of building permission. The building owner or the community of flat owners has an obligation to arrange the certificate for the purpose of a sale of the whole building, its part or for a lease of such a real estate. The data in the certificate have to be mentioned in the advertisement under which the sale or lease of the building is offered. The house owner is obliged to present the certificate to the buyer or lessee before the contract is signed and to hand it over by the sign of such contracts. In the future the obligation to arrange the certificate should apply on all real estate owners included owners of flats and family houses, regardless of the disposition with the real estate. The fine for breach of the above mentioned obligation amounts from 100.000,- CZK to 5.000.000,- CZK.
