An Amendment to Consumer Protection Act

An amendment to Act No. 634/1992 Coll., consumer protection act, came into effect.

On the basis of this amendment the seller (i.e. a businessman who sells a consumer goods or provides services) is obliged to state under the purchase offer the following essential information (if they are not apparent from the context):

-          main characteristics of the product or the service;

-          the address and the identity of the seller;

-          the price including taxes and fees;

-          provisions of payment terms, delivery, performance and handling complaints;

-          right on withdrawal of the contract or termination of the obligation.

 

Since February 1, 2016 the seller is also obliged to inform the consumer clearly and understandably about the subject responsible for out-of-court solution of the consumer disputes that is competent for the solution of the disputes of the given product or service. The information has to include Internet address of such subject.

In case the seller owns a website, the seller is obliged to state the information according to the previous subsection also on this web site. If the contract concluded between the seller and the consumer refers to general terms and conditions, the seller is obliged to state this information also in these general terms and conditions.
