Amendment of the Civil Code

More than one year ago we informed you about the planned amendment of the Civil Code.

As of 26 October 2016 the Chamber of Deputies adopted the amendment of the Civil Code, i.e. in case the amendment will be adopted also by the Senate and will be signed by the president, it will be the first change (amendment) of the Civil Code.

The changes brought by the amendment are in particular following:

-       re-introduction of the pre-emptive right for the co-owners of the properties;

-       re-introduction of the possibility to conclude an employment contract immediately after reaching the age of fifteen, where the day of commencement  of work cannot be concluded before the termination of compulsory education;

-       the reduction of the maximum amount of the deposit for a rented flat from the amount of six times the lease to the amount of three times the lease;

-       introduction of the public register of trust funds;

-       the possibility to prolong the period for evaluation of the legal capacity up to five years (nowadays three years).  

The majority of the changes should become effective two months after the publishing in collection of laws. The exception is for example the pre-emptive right that should become effective since 1 January 2018.
