Amendment of the Civil Code

The Government of the Czech Republic agreed that an amendment to Act No. 89/2012 Coll., the Civil Code, should be adopted. The aim of the amendment is to eliminate the most conflict situations that arise from the application of the new Civil Code.

The most important suggested changes are: re-introduction of the pre-emptive right for the co-owners of the properties, introduction of the public register of trust funds, a possibility to prolong the period for evaluation of the legal capacity from three to five years and cancellation of the requirement to adjust names of associations and associations of unit owners that were established before the Civil Code came into effect. In some cases a power of attorney with officially certified signature instead of a power of attorney in the form of a notarial deed will be sufficient.
