Cybernetic threats while working from home

Czech Office for Personal Data Protection has summed up und published on its website some rules and recommendation for home-working to minimalize threats and risks while working with IT, mobile communication and webs.

People working from home come out of the secure surroundings of the employer’s structure. Experience shows that employees are less watchful for cybernetic attacks in privacy in comparison with the workplace. But a mistake made here could seriously affect the whole organization.

Draft of a New Act on Registration of Beneficial Owners

The Ministry of Justice of the Czech Republic prepared a draft of a new Act on Registration of Beneficial Owners of Legal Entities. The Draft implements the so called 5^th AML directive (Directive EU 2018/843 of the European Parliament and of the Council of 30 May 2018 amending Directive (EU) 2015/849 on the prevention of the use of the financial system for the purposes of money laundering or terrorist financing, and amending Directives 2009/138/EC and 2013/36/EU) that aims to secure that the information regarding the beneficial owners will be published and that introduces penalties in case the obligations regarding the identification of the beneficial owners will not be fulfilled.

Extensive Amendment of the Business Corporations Act

On February 13, 2020 an Act No. 33/2020 Coll. that modifies the Act No. 90/2012 Coll., Business Corporations Act, was published in the Collection of Laws. Minimum wage growth

According to a press release of the Ministry of Labor and Social Affairs, the coalition partners agreed to increase the minimum wage next year from 13350 CZK to 14600 CZK, which represents 40,5% of the average wage in the Czech Republic.

Amendment to the Local Fees act

On November 6^Th 2019 there has been published an amendment to the Local Fees act in the Collection of Laws.

It is clear, that the legislator has been in favour of a better systematic breakdown of the already outdated Local Fees act. At the same time, the legislator also decided to introduce a new spa and recreational stay fee and accommodation capacity fee.

The Amendment to the act will become effective from January 1^st 2020.

Compensation for air passengers

The Court of Justice of the European Union stated in his judgment of 10.07.2019, file no. C-163/18 – HQ, IP, JO v. Aeagan Airlines, that a passenger who has the right to the tour operator for reimbursement of the purchase price of the Flight ticket according to the Directive 90/314/EEC, cannot claim the reimbursement of the purchase price of the ticket from the operating air carrier, even if the tour operator has been bankrupt.

Right of first refusal under §3056 of Act No. 89/2012 Coll., Civil Code

In the present case, the applicant was the sole owner of the land and the defendant was to owner of a 92/183 holding in the building, which was built on the land owned by the applicant. The remaining co-owner of the House were third parties. The defendant acquired the ownership share of the house on the basis of two purchase contracts from the previous ownership shareholders. The applicant sought the replacement of the expression of will – conclusion of the purchase contract under the pre-emptive right by the transitional provisions of §3056 of Act. No. 89/2012 Coll., Civil Code. The dispute was decided by the Supreme Court of the Czech Republic.

WLN Conference in Lisbon
