Labour Law in Practice - Training for top and middle management

The new Act on the Public Registers of Legal Entities and Natural Persons

With respect to the passing of the new Civil Code and the cancellation of the current Commercial Code, Act No. 304/2013 Coll, on the Public Registers of Legal Entities and Natural Persons was published in the Collection of Laws of the Czech Republic on 30.09.2013. This Act includes regulation of association registry, commercial registry and foundation registry, registry of institutes, associations of owners of units registry and registry of generally beneficial societies.

Extending of the scope of the financial arbiter activities

Upcoming changes in the Institute Discharge according to the planned amendment of the Insolvency Act

The Chamber of Deputies approved in August 2013, an amendment to the Insolvency Act, which among others, changes the regulation of the discharge. Due to the current statutory conditions a debtor-natural person, who is not an entrepreneur, may request for discharge. Newly for the discharge could request also natural person, which is doing business as a freelancer, on condition that his/her debts are not from doing his/her business.

Establishment of the right of easement to the plot in co-ownership of unit's owners without charges on the units

The Act on Ownership of Flats creates a close interrelationship of the ownership of unit, co-ownership of common parts of building, in which the unit finds, and co-ownership of plot, on which the building is located (if the owner of building is also the owner of plot). By entry of the easement for use of the plot, cadastral offices in practise conditional the entry of the easement for the plot at the same time by restriction of the ownership to the unit. The cadastral offices justify this by the close interrelationship of the co-ownership of common parts of building, the plot and the ownership of unit.
