The Equality of Participants of Court Proceedings when Deciding about the Reimbursement of Court Proceedings

According to the Civil Procedure Code, the administrative costs of the proceedings (such as a postage) expended by the participant of the proceedings who is represented by an attorney shall be reimbursed in a flat rate of 300,- CZK as for one legal act. The participant who is not represented by the attorney must prove the exact amount of expended administrative costs.

Court fee should always be considered as expedient cost of the proceedings

Pursuant to the provision of Section 142 of the Civil Procedure Code (Act No. 99/1963 Coll.), the court shall provide the participant achieving complete success in the matter with the reimbursement of costs necessary for the efficient exercising of a right against a participant unsuccessful in the matter. Limits on mandatory cash payments are to be stricter

The Chamber of Deputies and the Senate of the Parliament of the Czech Republic have recently adopted an amendment to the Act Nr. 254/2004 Coll., on Limitation of Cash Payments.

 According to the Act on Limitation of Cash Payments, if the payment exceeds an amount of 350.000,- CZK, it must be transferred to a bank account. The adopted amendment decreases this limit to the amount of 270.000,- CZK.

 It is expected that the amendment shall become effective as of 1st December 2014.

Changes in sanctions for enabling performance of illegal work

On 9 September 2014, the Constitutional court issued an interesting decision (Pl. ÚS 52/13) concerning Sec 140 Subsec. 4 letter f) of the Act on Employment (Act No. 435/2004 Coll.). According to this provision a fine from at least CZK 250,000 up to CZK 10,000,000 can be imposed for an administrative offence enabling performance of illegal work.

Refusal of Insurance Benefit Due to Untruthfully Given/Provided Data

The Supreme Court of the Czech Republic dealt in its decision as of 9.9.2014, reference number 23 Cdo 1735/2014, with a following question: is an insurer entitled to refuse the insurance benefit if the insured had given the insurer within the negotiation of the insurance contract untruthful data regarding the price and the damage of a car, which was subsequently stolen?
