An Amendment to Consumer Protection Act

An amendment to Act No. 634/1992 Coll., consumer protection act, came into effect.

On the basis of this amendment the seller (i.e. a businessman who sells a consumer goods or provides services) is obliged to state under the purchase offer the following essential information (if they are not apparent from the context):

-          main characteristics of the product or the service;

Usual Maintenance and Small Improvements of the Flat

A new decree of the Government No. 308/2015 Coll., on defining the terms usual maintenance and small improvements of the flat that are connected with the use of a flat, was published in the Collection of Laws. The decree of the Government came into effect on 1^st January 2016.

Taxation of Real Estate

An amendment to Act No. 235/2004 Coll., on Value Added Tax, came into effect on 1^st January 2016. This amendment introduces changes in the field of taxation of real estate and exemption from taxation.

News on Energy Performance Certification

Since January 1^st, 2016 the obligation of the owner of a building or a unit to obtain an energy performance certification of building will be extended.

Non-use of clothing determined by employer

The Supreme Court of the Czech Republic recently issued a judgement (as of July 25^th, 2015, Reference Number 21 Cdo 2930/2014), in which it dealt with a question if non-use of clothing determined by employer can be considered as breach of a duty arising out of the legal regulations applicable to the work performed by the employee.

Filing an Application of Receivables in the Insolvency Proceedings

Creditors shall file the applications of the receivables until the expiry of the deadline set out by the decision on the insolvency. The applications, which are filed later, shall not be considered by the insolvency court and thus claimed receivables shall not be satisfied in the insolvency proceedings.

New Act on Public Procurement

A Government’s proposal of a new Act on Public Procurement was introduced to the Chamber of Deputies. This Act will replace the Act No. 137/2006 Coll., on Public Procurements.

Amendment to Minor Offences Act

A new amendment to Act No. 200/1990 Coll., Minor Offences Act, came into effect on 1 ^st October 2015.

Delivery of documents to employees

Written materials that are being delivered by an employer by means of an operator of postal services shall be sent by the employer to the last known address of the employee.
