Tax Infobox

On the basis of the amendment to the General Fiscal Code (Act No. 280/2009 Coll.), the authorities have activated a tax infobox for all taxpayers to whom the databox was activated.

CONSEQUENCES OF THE EXCESSIVE REQUIREMENT OF THE CONSENT WITH THE PROCESSING OF PERSONAL DATA

In the context of the processing of personal data it is important to distinguish between the situations when the consent of the data subject is necessary and when there is no need of such consent. The Office for Personal Data Protection (of the Czech Republic) has recently given its statement regarding the situations where a controller requires the consent although it is not necessary.

The obligation to the proportionality of the distraint

The Supreme Court has recently issued a judgement (No 21 Cdo 855/2014), in which it expressed its opinion to the principle of the proportionality of the distraint. Abuse of this principle means the abuse of the law.

Limits on mandatory cash payments are to be stricter

The Chamber of Deputies and the Senate of the Parliament of the Czech Republic have recently adopted an amendment to the Act Nr. 254/2004 Coll., on Limitation of Cash Payments.

 According to the Act on Limitation of Cash Payments, if the payment exceeds an amount of 350.000,- CZK, it must be transferred to a bank account. The adopted amendment decreases this limit to the amount of 270.000,- CZK.

 It is expected that the amendment shall become effective as of 1^st December 2014.
